Appeals and Complaints Process

Appeals

ABS Quality Evaluations, Inc. ("ABS QE") provides its clients with a contractual right of appeal. The appeals process provides a formal procedure for resolving client and third party disputes as to rulings, determinations or actions by ABS QE related to certification. All appeals must be in writing and addressed to:

Disputes are to be submitted to the Certification Department. If the issue is still not resolved, the client may file an appeal to the Operations Department. If the issue is still not resolved, the client may appeal to the President of ABS Quality Evaluations. If a mutual agreement has not been reached after the President has reviewed the situation, the client may request an additional appeal under the Rules of Conciliation and Arbitration of the International Chamber of Commerce. The arrangements for a higher appeal are made by the Manager of Certification and such an appeal will be governed under New York law and shall be heard in Houston, Texas.

Complaints

Complaints against ABS Quality Evaluations, Inc. or any of its clients, may be submitted to any employee of ABS Quality Evaluations. Complaints may be submitted in any form of communication, including by letter, fax, e-mail, in person or by phone. The recipient of the complaint will attempt to resolve the issue, if possible, and document the results on an official form. The official form would then be forwarded to the Business Development Department. If further action is needed, the Manager of Certification will take the necessary steps to make sure that the complaint is dealt with in a timely manner. Throughout this process, the originator of the complaint will be notified of the progress of resolution until the complaint has been resolved and the matter closed.
